Acceptance of Terms
By accessing or using Notive (“the Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a facility or organisation, you represent that you have authority to bind that organisation to these terms.
Description of Service
Notive is a voice-to-documentation platform designed to assist aged care staff in creating handover notes. The Service uses artificial intelligence to structure spoken observations into professional, structured documentation. All notes require human review and approval before they are finalised.
Notive is a documentation tool. It does not provide medical, clinical, or legal advice. All clinical decisions remain the responsibility of qualified care professionals.
Early Access
During the early access period, Notive is provided free of charge with no credit card required and no lock-in commitment. We reserve the right to introduce paid plans in the future with reasonable notice to existing users.
Acceptable Use
You agree to use Notive only for its intended purpose: documenting care observations for aged care residents at your registered facility. You must not:
- Use the Service to document information about individuals outside your facility
- Share login credentials with individuals not employed at your facility
- Attempt to access data belonging to other facilities
- Reverse engineer, copy, or redistribute any part of the Service
- Use the Service in any way that violates applicable Australian law
Data & Privacy
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these terms. By using the Service, you consent to our data practices as described in the Privacy Policy.
You are responsible for ensuring that your use of Notive complies with the Privacy Act 1988 and the Aged Care Quality Standards, including obtaining any necessary consents from residents or their representatives where required.
Accuracy of Documentation
Notive's AI produces draft notes based on spoken input. These drafts must be reviewed and approved by a care professional before finalisation. You are responsible for the accuracy and completeness of all finalised notes. Notive does not warrant that AI-generated drafts will be accurate, complete, or suitable for clinical or legal purposes without human review.
Finalised Records
Once a note is finalised, it is permanently sealed and cannot be altered by any party. This is a deliberate feature designed to ensure audit trail integrity. If an error is discovered in a finalised note, the correct process is to document a correction in a subsequent note, not to alter the original.
Service Availability
We aim to provide a reliable service but do not guarantee 100% uptime. The Service is provided “as is” without warranty of any kind. We are not liable for any loss arising from service unavailability or interruption.
Intellectual Property
The Notive platform, including its software, design, and branding, is the intellectual property of Notive. The documentation you create using the Service belongs to you and your facility.
Limitation of Liability
To the maximum extent permitted by Australian law, Notive's liability is limited to the amount you have paid for the Service in the preceding 12 months. We are not liable for indirect, consequential, or incidental damages.
Changes to Terms
We may update these terms from time to time. Significant changes will be communicated to facility administrators with at least 14 days' notice. Continued use of the Service constitutes acceptance of updated terms.
Governing Law
These terms are governed by the laws of South Australia, Australia. Any disputes will be resolved in the courts of South Australia.
